After a chemical spill from a storage tank in West Virginia earlier this year dumped 7,500 gallons of MCHM into the Elk River in Charleston and left hundreds of thousands without water for days, the state’s legislature quickly put new regulations for storage tanks into law. One of these regulations involves the creation of a database of every aboveground storage tank in the state.
In order to create this database, the state has launched a website where aboveground storage tank owners can register their tanks. The website includes a brief questionnaire which allows users to determine whether or not they need to register their tank or tanks. Depending on the nature of the tank, it may or may not need to be registered with the state.
The anticipated opening date for registration is June 10th, and the registration period will run until October 1st, at which point all tanks must be registered. There is one exception to this rule which concerns NPDES (National Pollutant Discharge Elimination System) permit holders who have aboveground storage tanks within the zone of critical concern specified in the statute. These tank owners must apply for an NPDES Individual Permit by September 1st.
